BOOKING CONDITIONS
MICHAEL & DAWN POWELL LIMITEDReservations are accepted by Michael & Dawn Powell Limited (M&DP) and the Owner only on the conditions shown on the Booking Form together with the following booking conditions (“the Booking Conditions”).
1. The Applicant certifies that he or she is authorised to sign the Booking Form on behalf of all persons who will occupy the property during the period for which he has booked it and they are all, apart from infants, aware of the Booking Conditions.
2. No booking will be accepted by M&DP unless a Booking Form has been completed by the Applicant and accepted by M&DP. All contracts will be deemed to have been made in Cornwall and are in accordance with and subject to English Law.
3. Extras are charged at certain properties as indicated in the description and/or the Price List of the properties concerned. When booking these properties the Applicant accepts the right of M&DP to charge these extras.
4. The Applicant should take out insurance to ensure that in the event of not being able to take up a holiday M&DP will be paid in full. The Applicant remains liable for the final payment on the due date as indicated by M&DP’s Invoice and failure to make such payment in full at the time will be treated as a Breach of Contract. On receiving the cancellation M&DP will offer the holiday again at a price which in its experience is most likely to result in the property period being re-let. If this is achieved the Applicant will be refunded with all the monies he has paid less £80 per booking week and any losses incurred in re-letting the property including loss of rental.
5. Final Payments set out in the Booking Form are due four weeks before a holiday commences and this is shown as the due date on the Invoice. If the final amount is not paid on the due date M&DP will then advise the Applicant at the address given by the Applicant on the Booking Form that his booking is cancelled and his initial payment is forfeit and that he remains liable for the full amount of the final payment. Without further delay M&DP will offer the property once more at whatever price it feels appropriate. In the event of a re-let repayment shall be paid to the Applicant after deduction of any difference in the rental received on re-letting together with any reasonable administrative or professional costs in connection with such re-letting.
6. Pets are allowed in certain properties and these are indicated on the Price List. They are accepted subject to their owner accepting liability for any damage they may do and on the condition that they will not be left unattended in the property. Pet owners are expected to bring suitable bedding for their animals. A charge of £25 per pet per week is made. Any Applicant who takes a pet into a property without permission or without notifying M&DP or on the Booking Form is in Breach of Contract and the M&DP has the right to terminate the booking forthwith and to retain all monies paid by the Applicant.
7. Properties are available from 4pm on the “holiday start date” until 10.00am on the “holiday finish” date as shown the Invoice. These times must be strictly adhered to except by special arrangement with the owner or his key holder.
8. In spite of care and precautions taken it is possible that Applicants could have grounds for complaint about the property they have chosen. Any complaint must be taken up immediately with the key holder or owner before the Applicant vacates the property. A signed Booking Form is taken as proof that you have read, understood and agree with these Booking Conditions and will abide by them. Under no circumstances shall the Owner of the property or M&DP’s liability to the Applicant exceed the amount paid to M&DP for the rental period.
9. Whilst representations both verbal and visual contained in our brochure and in other advertisement matter are made in good faith and carefully scrutinised, no warranty or representation is given to the state of any property. The colours shown in photographs may not be accurate and some digital photographs may have been enhanced or otherwise there may also be changes to décor, furnishings or fabrics or seasonable variations.
10. The use of properties and all amenities is entirely at users risk and no responsibility can be accepted for any injuries to persons or loss or damage to any belongings of persons who use them save as provided in clause 12 below.
11. If the property should not be available owing to damage by fire or storm or for any other reasons outside the control of M&DP or for any reason M&DP is not able to comply with this agreement the Applicant shall be refunded the full amount of monies paid and M&DP’s liability is limited to the refunding of such monies.
12. Except in respect of death or personal injury caused by the negligence of M&DP or the Owner and their respective servants and save to the extent provided in clause 11 neither M&DP or the owner of any property will be liable for any accident, damage, direct or consequential loss, injury, expense or inconvenience whether to person or property which the Applicant or any other person may suffer arising out of, or in any way connected with the letting howsoever caused.
OVERSEAS VISITORS
Applicants residing abroad may pay by Bank Transfer to our Bank Account with an additional £20 to cover bank charges. Alternatively payment may be made by Euros into our Euro Bank Account at Lloyds TSB. Please contact for further details.
